Historically, new technologies challenge "settled" conceptions of privacy. "The Right to Privacy," Samuel Warren and Louis Brandeis' famous essay (Warren and Brandeis, 1890), was a rejoinder to giant printing presses, the invention of photography, and the industrialization of news reporting. Early in the twentieth century, telephone tapping, electronic eavesdropping, camera monitoring, and polygraph devices triggered new interest in privacy as a philosophical and legal concept (Westin, 1967; Fried, 1970; Friedrich, 1971; Simmel, 1971; Rachels, 1975; Scanlon, 1975; Thomson, 1975). Recent work on privacy has examined the ways in which respect for privacy can be balanced with justifiable uses of new and more sophisticated technology, such as DNA profiling, thermal imaging, and face scanning (Agre and Rotenberg, 1997; Brin, 1998; Etzioni, 2000). Finally, at least one modern author suggests that the risks now presented in technologically advanced societies "go well beyond anything that quests for 'privacy' or 'data protection' can cope with on their own" (Lyon, 2003: 2).
