Laurence Tribe, Tyler Professor of Constitutional Law at the Harvard University Law School, has proposed a Twenty-Seventh Amendment to the United States Constitution which would do for cyberspace what the Ninth Amendment did for protecting rights and espousing values not expressly stated in its text. That is, it would render applicable to the new technological terrain the constitutional protections developed during its construction—thereby acknowledging the reality of originally unspecified rights held by individuals. As proposed, it would state: "This Constitution's protections for the freedoms of speech, press, petition, and assembly, and its protections against unreasonable searches and seizures and the deprivation of life, liberty, or property without due process of law, shall be construed as fully applicable without regard to the technological method or medium through which information content is generated, stored, altered, transmitted, or controlled"(Tribe, 1991). While it is unknown how much legitimacy such a proposal is given, its contents speak volumes about what is apparently imperative to constrain unethical and infringing behavior by corporations and organizations online.
