Utilities in the Pacific Northwest are fighting the Bonneville Power Administration over proposed supplemental wholesale power rates that attempt to recoup from the utilities some financial benefits gained from a rate relief program that has run into trouble in court. In two decisions last year, the US Court of the Appeals for the 9th Circuit invalidated aspects of a rate relief program and the settlement agreements connected to that program. That led BPA to propose supplemental wholesale power rates for fiscal year 2009. The supplemental rates are meant to recover various utility benefits that, as BPA sees it, have been invalidated - but utilities dispute many of the significant elements in BPA's calculations. BPA has no business including load reduction agreements along with the settlement agreements on the rate relief program, according to a filing at the Federal Energy Regulatory Commission by a group of five investor-owned utilities. BPA entered into binding load reduction agreements, the IOU group said in its filing. "Although these contracts were subject to legal challenge, there was no successful legal challenge; therefore, these contracts remain valid and enforceable agency actions, i.e., contracts; and they are not subject to collateral attack by those who seek to negate them at this late date," the group said.
