The EU's power sector is still not complying fully EU rules on cross-border power trade and congestion management, the European Regulators Group for Electricity and Gas said on September 17.rnWhile there had been some progress, rules also needed to be amended "to remove ambiguities, to improve clarity and to reduce the possibility of arbitrary interpretation," Ergeg said in its second compliance report on the 2003 EU regulation on cross-border trade and binding congestion management guidelines.rnErgeg is to propose "appropriate amendments" to the European Commission, on issues such as how grid operators maximize transmission capacity, how they treat capacity curtailments, and when and how they are to use counter-trading and re-dispatching.rnErgeg is also to advise the EC on what happens in the market when one grid operator uses congestion income for re-dispatching while others use it to build new lines. Ergeg notes that full compliance with the current rules is only possible if national energy regulators' powers are harmonized across the EU, and that in some cases national laws have to be changed.
