Most public contracts contain liquidated damages clauses, which set daily amounts assessed against a contractor that fails to complete the project in a timely manner. Although initially viewed as an unlawful penalty in early court decisions, liquidated damage clauses are generally enforced today. Consequently, when a court rejects a liquidated damages clause, it is newsworthy. In Boone Coleman Constr., Inc. v. Village of Piketon, 13 N.E.3d 1190 (Oh. App. 2014), a contractor entered into a $683,300 contract with the village of Piketon to install a traffic light and perform improvements to a busy intersection. The contract stated that work must be substantially completed within 120 days or the contractor must pay $700/day as liquidated damages. When the contractor finished the project 397 days late, the village assessed damages of $277,900 against the contractor.
