Risk assessment is the cornerstone of health and safety management and is now the central feature of our health and safety legislation. To be able to assess risk, it is self-evident that a person will need to understand what the term means, yet, in our laws, there is no definition of 'risk'.rnIt is not uncommon, where a workplace injury or death occurs, for there to be an allegation that the employer failed to assess a particular risk adequately, or at all. Thus, it is worth considering how the criminal courts approach the issue of risk.rnIn R v Board of Trustees of the Science Museum [1993] 3 All ER 853, concerning a prosecution for a breach of section 3 of the HSWA 1974, the Court of Appeal said 'risk' was not confined to actual danger but included the 'possibility of danger'. During the course of the appeal, the HSE's counsel gave an example to illustrate the varying degrees of risk.
