The US Department of Energy (DOE) announced June 5 that it will publish in the Federal Register a “Supplemental Notice Concerning US Department of Energy Interpretation of High-Level Radioactive Waste.” In that notice, DOE updates its October 10, 2018 request for public comment on the statutory term “high-level radioactive waste (HLW),” as defined in the Atomic Energy Act of 1952 (AEA), as amended, and the Nuclear Waste Policy Act of 1982 (NWPA), as amended (SpentFUEL No. 1231, October 12, 2018). DOE’s revised interpretation of the term, HLW, is that not all reprocessing wastes are HLW, and may be disposed of in accordance with their radiological characteristics.
