The California Supreme Court will allow a lawsuit to move forward that accuses Pfizer and 18 other drugmakers of conspiring to prevent lower-priced drugs from Canada to enter the U.S. market, overturning a lower court ruling.rnThe court, in effect, dismissed the drugmakers' claim of a "pass-on" defense that argued that the plaintiffs, 15 San Francisco-area pharmacies, passed on any alleged overcharges to consumers and therefore were not financially harmed. The case will have far-reaching impact on price-fixing in pharmaceutical cases throughout the country, Joseph Alioto Jr., the plaintiffs' attorney, told WDL Tuesday.
