EPA and environmentalists have signed a settlement agreement setting deadlines for the agency to rework aspects of its Clean Water Act (CWA) general permit program for small municipal stormwater systems, creating a timeline for final action on a new rule 12 years after a federal appellate court ordered the revisions. In an Aug. 26 joint motion to the U.S. Court of Appeals for the 9th Circuit, EPA and environmental groups ask the court to approve their agreement requiring the agency to propose a new "Phase Ⅱ" stormwater permit for small municipal separate storm sewer systems (MS4s) by Dec. 17, and to finalize it by Nov. 17, 2016.
