This is another detailed and exhaustive analysis by the English Patents Court. Although reaching an entirely logical decision all-square with current English law, given that the relevant jurisprudence has its origins over 140 years ago and European patent law has separate provisions governing exhaustion, this is a case which appears ripe for consideration by the higher courts. An appeal would seem inevitable.
