A Texas appeals court Sept.23 dismissed most of a landowner's property contamination claims against a pipeline operator because they were based on pre-purchase,permanent injuries(penman v.SND Operating,Tex.App.,6th Dist.,No.06-04-00061-CV,09/23/05).Included in the claims that could not go forward,the Texas Court of Appeals for the Sixth District held,were those alleging old,unused pipelines and other oil equipment contaminated the landowner's property and interfered with the landowner's ability to farm the land.
