After reviewing more than 22,500 comments about reissuing nationwide permits under Section 404 of the Clean Water Act, and with the current set of permits set to expire on March 18, the Army Corps of Engineers has decided to reissue all NWPs. In addition to the controversial NWP 21 that controls valley fills, the Corps is issuing a new permit - NWP 50 - that will be required for underground mining. It is designed to protect streams that might be affected by the mining or the surface work associated with the mine, the Corps said. Its requirements will be similar to NWP 21, the Corps said.
