Proponents of the US state of Hawaii’s Maui County’s ban on genetically modified crops have asked the US District Court of Appeals for the Ninth Circuit to reverse a judge’s decision to delay implementation of the local ordinance. The SHAKA Movement, which led the effort to get the ban approved, says that the preliminary injunction is not in the “public interest” and that the order should be revoked. “This injunction effectively denies Maui County voters their right to pass laws to protect the environment and human health,” the group argues. “Although there are serious questions going to the merits of this dispute, the District Court’s application of the other factors were clearly erroneous and thus an abuse of its discretion.”
