Mandatory Neurointervention: A Lesser Evil Than Incarceration?

Evaluating the merits of using neurointervention in the criminal justice system requires considering a broad range of issues. In their article, Birks and Buyx (2018) focus on mandatory neurointervention’s threat to mental integrity. The authors make a valuable contribution to the literature by advancing this argument. We seek to broaden the scope of the discussion to address the relative threat to autonomy that mandatory neurointervention poses compared to incarceration. However, we do not seek to make a normative judgment about the use of neurointervention. Elsewhere, we have addressed some of the legal and ethical issues associated with using neurointervention to reduce recidivism, and as a condition of early release (Shniderman and Solberg 2015). Whether the benefits outweigh the costs of mandatory neurointervention is beyond the scope of our discussion. In this article, we conclude that mandatory neurointervention and incarceration each pose similar threats to offender autonomy, and in some cases mandatory neurointervention may represent an opportunity to increase an offender’s autonomy and mental integrity.
