One of the few ways to protect land used by local people is through registration of that land through s.15 of the Commons Act 2006.Under this provision,an application can be made to register land as a”town or village green”(“TVG”) where a”significant number of the inhabitants of any locality,or of any neighbourhood within the locality,have indulged as of right in the lawful sports and pastimes on the land for the period of at least 20 years”.Such registration protects the land from development.The kind of”land” covered by this section has broadened over time;it also makes no distinction between land held privately and publicly.But the authorities have begun to limit the circumstances in which an application for registration would succeed where the land is held publicly.
