Законодательная база лииензиро-ль вания недропользования основывает-ся на двух основных документах: Законе РФ "О недрах" 1992 г. с последующими изменениями и дополнениями и "Положении о порядке лицензирования пользования недрами", утвержденном Верховным Советом РФ 15 июля 1992 г. Основными проблемами государственной системы лицензирования недропользования являются следующие: отсутствие должного контроля и мониторинга выполнения условий лицензий, обязательств недропользователей и как следствие - недостаточная эффективность использования минерально-сырьевых ресурсов и отсутствие достоверной информации даже о числе выданных и действующих лицензий;The main shortcomings of the state system of mineral resource use licensing are as follows: the lack of proper control over the fulfillment of license terms and conditions and obligations of mineral resource users and their monitoring; the lack of objectivity when decisions on granting the rights to use mineral resources are taken; inadequate statement of mineral resource users' obligations and other conditions of mineral resource use in license agreements, the lack of the unified practice and single approach to issue and drawing up of licenses; the application principle of obtaining licenses. The consequence of the above shortcomings is notorious statistics: 91.2 percent of crude oil reserves and 83.0 percent of gas reserves are in the distributed stock. Major oil companies are provided with reserves for 35 years at the current rate of production; this is approximately 3 times as much as reserves of leading corporations of world crude oil business. Two "diseases" that result from this are: first, companies have no inducement to invest in geological exploration and, second, they develop the most paying fields with high-flow rate wells conserving less paying ones, freeze investment in new technologies enabling to increase efficiency of development and oil recovery.
