Polish law protects intellectual property, and the licensing of foreign brand names and products is accepted practice. Licensing is prevalent in high-tech industries, pharmaceuticals and retail franchises. Licensed products produced in Poland may be exempt from import tariffs and excise duty. They may also benefit from classification as Polish products.EU regulations on community trademarks (CTMs) automatically came into force in Poland upon accession to the bloc in 2004. The regulations establish procedures for CTM registrations that extend automatically to all EU member states. All CTMs filed for registration and registered within the EU obtained legal protection in Poland as of May 1st 2004.The main applicable law in Poland is the Industrial Property Act (2000), which superseded the Law on Invention (1972) and the Trademark Law (1985). The 2000 law was introduced to align Polish regulations with EU standards. It covers inventions, utility designs, trademarks, industrial design, geographical indications and topographies of integrated circuits. The most recent amendment to the Industrial Property Act, adopted in 2019 and entering into force in February 2020, aims to align Polish law further with the European Patent Convention and the Patent Co-operation Treaty. Two additional legal rulings apply to the protection of copyrights: the Berne Convention on Copyright and the Copyright Act (1994). Protection extends to literary works, software, scientific works, artistic works and photographs, and musical recordings.
