Chief negotiators from a number of countries participating in the Trans-Pacific Partnership (TPP) talks signaled in the Dec. 12 closing press conference that countries remain far apart on key issues like disciplines for state-owned enterprises (SOEs) and patent protections for pharmaceuticals. Australia's chief negotiator, Hamish McCormick, said Australia had put forward "papers" in the area of SOEs in this round as a way of finding a compromise that reflects the common interests of TPP participants. A private-sector source said that Australia had tabled non-binding "principles" on SOEs as an alternative to the U.S. proposal that seeks binding commitments for ensuring "competitive neutrality" between SOEs and private firms. Malaysia's chief negotiator, J. Jayasiri, also indicated that Malaysia is opposed to the U.S. SOE proposal. He said there are a number of issues in that proposal that "we're not comfortable with" and noted that his country is "free to table proposals" in the negotiations. Jayasiri made clear that Malaysia's objections were broader than those raised by Khazanah Nasional, the Malaysian government's strategic investment fund, and stem from the interests of other SOEs in his country. He did not respond to questions on whether Khazanah was directly participating in the negotiations as part of the Malaysian delegation, as some observers have said.
