In the second term of the Obama administration, the Commerce Department's Bureau of Industry and Security (BIS) plans to pursue two policy tracks: one will focus on improving the Export Administration Regulations (EAR) through administrative actions, and the other will be to complete the export control reform initiative which focuses on rewriting existing lists, according to a senior administration official. "Most of our time and attention has been devoted to this [United States Munitions List] to Commerce Control List process - the positive USML rewrite ... that's still the right approach given the volume and the size," the official said. "But there's a significant amount of housekeeping within the EAR that needs to be done on outdated provisions." Any issue that will be raised under the second policy track will have to fulfill two criteria: it will have to be specific to the EAR and not require any statutory changes, he said.
