After almost two years of uncertainty, the EU is now progressing towards the adoption of harmonized rules on the law applicable to divorce through the activation, for the very first time, of the enhanced cooperation mechanism. The question of the law applicable to divorce (Rome III) has been on the agenda of the Commission for over 10 years. A Green Paper, published in March 2005, showed that the combination of the application of rules of jurisdiction, recognition and enforcement harmonized by the Brussels II and Brussels IIa Regulations, and of diverse domestic substantive and choice of law rules raised a number of difficulties. Following extensive consultations, on 17 July 2006 the Commission issued a proposal for a Council Regulation amending Regulation (EC) No 2201/2003 as regards jurisdiction and introducing rules concerning applicable law in matrimonial matters.
