Whenever anything goes wrong these days the search for who is to blame and who to sue starts. Society appears to be becoming increasingly litigious and the Legal obligations owed to others seem to be growing. We have all heard the story of the customer who sued McDonalds claiming their coffee was too hot. Is this the way we are headed? The general principle in Scotland is that a duty of care is owed to those who are closely and directly affected by your acts and who you should have in mind as possibly being affected by your acts. For example, when we drive a car we have a duty not to hurt any other road users and the same duty applies between a doctor and his patient, or a professional and his clients. So what happens when things go awry?
