FERC Affirms Order on Subpoena Request by Energy Transfer Partners; McGraw-Hill Must Provide More Data; Judge Certifies Uncontested Settlement Involving Oasis Pipeline et al.
The Commission stood by a 9/4/08 order granting a request by Energy Transfer Partners LP (ETP) (IN06-3) for a subpoena compelling the McGraw-Hill Companies Inc. to provide certain natural gas trading data sought by ETP in its show cause proceeding. The September 4 order had directed McGraw-Hill to produce information on 11 trading points throughout the U.S. The two sides have been engaged in a procedural tug-of-war since July 2007, when ETP was ordered to show cause why it had not violated Market Behavior Rule 2 by manipulating wholesale gas prices at the Houston Ship Channel (HSC) and other Texas locations by suppressing prices to benefit its financial and physical positions. The company is seeking data on the compilation of Platts' Inside FERC price indices. The latest order, issued December 30, denied McGraw-Hill's October 6 request for reconsideration and compelled the production of the data within 14 days.
