Enserco Energy Inc. last month filed a protest with FERC claiming that Bridger Pipeline LLC (ISO9-193) is proposing a new, albeit lower, rate for all of its Little Missouri Pipeline flow movements and so the proposal needs to be treated as a cost of service adjustment case. Bridger says it is proposing a pre-established rate, which is not a "new" rate. Enserco also claimed that "Bridger is not utilizing" the indexing methodology to reduce the rate. This claim is also incorrect, according to Bridger. Last October, Bridger submitted a cost-of-service filing to establish a rate of 84.240 per barrel (bbl) for transportation on Little Missouri. No entity protested the cost-of-service rate filing, and the rate went into effect on 12/1/08. That rate constitutes the established ceiling level. Thus, for service on Little Missouri, the ceiling level for the current index year is 84.240/bbl. According to the indexing rules, "a rate charged by a carrier may be changed, at any time, to a level which does not exceed the established ceiling level." Since the proposed rate of 70.000/bbl is below the ceiling established under indexing, the new filing fully complied with the Commission's regulations, Bridger responds.
