Nevada believes that irreparable harm will be done to the state if the 3809 regulations become law.The state of Nevada field suit in US District Court to stop the implementation of the US Bureau of Land Management's (BLM) 3809 regulations governing surfacing-mining activities on federal land. The suit states that the BLM and the US Department of the Interior exceeded their statutory authority when promulgating the regulations. In addition, Nevada argued that the BLM did not adequately notify the state or other interested parties that the final regulation would incorporate a "substantial irreparable harm" standard for rejecting mining plans.
