Following the tragic events at the Genwal Resources Inc. (Genwal) Crandall Canyon Mine in August, 2007, the U.S. Mine Safety and Health Administration (MSHA) took enforcement actions against both Genwal and one of its engineering consultants, Agapito Associates, Inc. (Agapito). MSHA issued a single citation to Agapito, alleging that the mining methods recommended by Agapito and used to extract pillars at the mine were unsafe. MSHA initially assessed the maximum possible penalty, $220,000, and designated the citation as "flagrant," alleging that Agapito had shown "reckless disregard" of the cited violation.
