Citing the Summitville Mine disaster, the Environmental Protection Agency (EPA) warned the state of Colorado to stiffen its regulation of water discharge at Cripple Creek and Victor Mining's (CCVM) Cresson gold mine near Cripple Creek or the federal agency will take control. In a letter to the Colorado Department of Health and Environment, EPA said the mining company's current draft discharge permit violates the Clean Water Act. The draft permit allows water coming from CCVM's property to contain cyanide levels nearly five times the usual standard for area waters.
