Over the years there have been various attempts to ensure that our domestic environmental impact assessment (EIA) regulations adequately address minerals development. The decision in R v North Yorkshire County Council ex parte Brown made it clear that the review of a mineral planning permission (ROMP) was to be regarded as a "development consent" for the purposes of the EIA directive.
