In K. (on the application of Celtic Energy Ltd) v Welsh Ministers [October 2011] a mining company appealed against a judgement refusing to quash a decision of the Welsh ministers to uphold refusal of permission for an extension to an opencast coal site.The site straddled two local authority borders and both had refused permission on the basis that the extension was located within 500 metres of a settlement.This conflicted with the ministers' Minerals Technical Advice Note 2: Coal (MTAN2).
