Challenge to Durham CC's decision that planning permission was not separately required for use of recycled liquid fuel in kilns at Lafarge's Thrislington Quarry, has been finally concluded in the Council's favour. Following her failure in the Court of Appeal the appellant, Mrs Lowther, petitioned the House of Lords for leave to appeal. The House of Lords considered her petition and decided that leave to appeal be refused. The progress of the matter has been previously reported in Waste Planning. Recycled liquid fuel consists of hydrocarbons and contaminants derived from waste organic solvents. Lafarge Aggregates Ltd operate kilns to produce lime products used in the steel industry. The main fuel is petroleum coke but this is supplemented in one kiln by up to 40 percent recycled liquid fuel. In 1996 Durham CC, based on advice received from Counsel, considered such use to constitute a material change of use.
