Tony Williams, head of planning law at Veale Wasbrough Lawyers, Bristol, and Martin Millmore, head of The Mineral Planning Group in Bradford, who both acted for Earthline, explain the significance of a recent High Court case on an issue "which will not go away".On 29 January 2002 Sullivan J in the High Court announced the decision on the Earthline case. Apart from a case summary in the Estates Gazette there appears to have been little commentary in the professional press. However, the authors believe the case has widespread implications for all pre-1982 mineral planning permissions. The Earthline decision confirms that mineral planning authorities have no discretion to impose a time limit on such permissions other than 22 February 2042.
