Changes to refineries needed to produce ultra-low-sulfur diesel should not result in shortages of the fuel, said EPA in its response to an oil-industry lawsuitchallenging the new fuel's regulations. In addition, refiners' investments to upgrade existing facilities to produce the new diesel would be no more than what they have paid to meet previous regulations, the agency said. The industry has been warningof fuel shortages and excessive costs due to the regulation.
