The conflicts between clinicians' duties to the courts and their duties to their patients represent a longstanding ethical dilemma for psychiatry and psychology. Candilis and Neal point to several circumstances in which these conflicts arise, including public safety. The authors also point to some of the guidelines and safeguards in place in the United States. In criminal cases, U.S. Supreme Court rulings outlawing 'deliberate indifference' to prisoner health (Estelle v. Gamble 429 U.S. 97, 1976), the doctrine of informed consent, the requirement that the police issue 'Miranda' warnings, and the requirement that defendants have access to counsel all help to ensure that the vulnerable are protected, whether or not the testimony of the forensic psychiatrist or psychologist advances their interests. Candilis and Neal point to the need for clinicians to balance their duties to justice, on the one hand, and welfare, on the other.
