In his order, Barbier said the non-jury trial will also determine if Transocean can use a maritime law originally created in the late 1800s to limit its total liability to about $25 million. The judge said the trial will not assess damages, but only who is to blame and the portion of blame that they will share. Barbier said the date was set because testing on the Macondo well's blowout preventer and lower marine riser package has not started and that findings from that investigation will be critical to determine blame in the accident. The personal liability cases from the disaster have been consolidated to Barbier's court in the US District Court -- Eastern District of Louisiana in New Orleans, while corporate cases have been assigned to the federal court in Houston.
