The court ruled that the environmental agency violated the federal Clean Water Act and the state's Water Quality Act by issuing the water-discharge permits. Under the permits, the company would have been allowed to dump water produced from CBM operations into the Tongue River without first treating it. In its order, the court gave the environmental agency 90 days to re-evaluate Fidelity's applications using the appropriate treatment standards.
