In the last issue we described the formation of an LLC as a flexible, legal entity for passing forest lands-and forest management traditions-within a family. In this article we explore some important elements of the family forest Operating Agreement.It is a "living" document that is easily amended by the founders of the LLC and helps future generations make good decisions regarding forest resources. One of the distinct advantages of forming a family forest LLC, is that it allows future generations to participate in making management decisions or simply enjoy the benefits of forests, but without 'hamstringing' future generations-a principal concern of many families. The terms of a family forest operating agreement are limited only by the creativityof the founders. Here are some ideas to get you started.
