Northern Natural Gas Company is an interstate pipeline that operates a gas storage facility known as the Cunningham Field. Trans Pacific Oil Corporation operates two producing wells that are located outside the certificated boundaries of the Cunningham Field. Northern sues Trans Pacific in federal court asserting Trans Pacific is producing Northern's injected gas that migrates from the Cunningham Field to Trans Pacific's wells. The jury finds that no NNG gas has migrated to Trans Pacific's wells on or after July 1, 1993 which is the effective date of a statute addressing the migration of injected gas. Following the jury verdict Northern seeks administrative relief at the Kansas Corporation Commission ("KCC") and the Federal Energy Regulatory Commission ("FERC").
