Just-in-time delivery, partial consumption, brokering, and commingling are all realities in the recycling industry that can interfere with reclamation. Even so, recyclers can take advantage of BAPCPA's other expanded provisions, such as the revised administrative expense claim-it's available to vendors even if they don't exercise their reclamation rights. These and other changes resulting from BAPCPA provide scrap recyclers some limited relief from the costs of customer bankruptcy. No matter what, vendors should evaluate the trade-offs of the new provisions before they exercise their new rights.
