The question of whether agricultural pesticide applications should be included in a general National Pollutant Discharge Elimination System (NPDES) permit EPA is drafting for certain pesticide uses has hovered over the development process. Concerns have been raised that by leaving out ag uses, applicators such as farmers applying pesticides to their crops without an NPDES permit could be sued for violating the Clean Water Act (CWA).
