In the March 12 Federal Register (75 FR 11740), EPA issued a final rule amending § 180.1281 by establishing a permanent exemption from the requirement of a tolerance for residues of the biochemical pesticide S-Abscisic acid, (S)-5-(1-hydroxy-2,6,6-trimethyl-4-oxo-1 -cyclohex-2-enyl)-3 -methyl-penta-(2Z,4E)-dienoic acid (ABA), in or on all food/feed commodities when applied or used pre-harvest as a plant regulator. Currently, there is a two-part temporary exemption for the biochemical pesticide when used on: (1) grapes in accordance with an Experimental Use Permit, due to expire Oct. 1, and (2) grapes, herbs and spices, leafy vegetables, pineapple, pome fruit and stone fruit in accordance with an EUP, due to expire Aug. 7,2012.
