The Civil Justice Reform Act (CJRA) of 1990 emerged from a multi-year debateabout ways to reduce delay and litigation costs in federal courts. The legislation required each federal district court to develop a case management plan to reduce costs and delay. The legislation also created a pilot program to test six principles of case management and required an independent evaluation to assess the effects of these principles and of other related case management techniques. The Judicial Conference and the Administrative Office of the U.S. Courts asked RAND's Institute for Civil Justice to conduct the evaluation in the ten pilot and ten comparison districts. The CJRA case management principles and techniques include the use of alternative dispute resolution (ADR). At the request of the Judicial Conference, we conducted a study of mediation and early neutral evaluation in six districts to supplement the ADR component of the main CJRA evaluation. This document describes the results of our supplemental analysis. Separate RAND reports describe how the CJRA as a whole was implemented in the 20 study districts and document our evaluation of the other case management principles and techniques specified in the act.
