JUDICIALLY ENFORCEABLE RIGHTS UNDER NEPA

The National Environmental Policy Act (NEPA) has been interpreted by the courts in many cases since its enactment in 1970. The majority of the cases which address the issue of substantive rights favor sub¬stantive review. But, the standard of review which is used varies depending on the court and the particular factual situ¬ation. Standards of review which have been used by the courts include a balanc¬ing analysis, the "arbitrary and capri¬cious" test, a substantial inquiry, and a good faith compliance with NEPA. The statutory sources of substantive review are sections 101, 102(1), 102(2)B of NEPA. In some cases by applying very strict procedural requirements, courts appear to achieve the substantive goals of NEPA of effecting changes in the federal agency decision- making process. The de-cisions show that the courts are proceeding on a case-by-case basis balancing environmen¬tal and traditional economic factors in order to achieve the substantive policies of NEPA .
