The United States-Chile Free Trade Agreement (U.S.-Chile FTA), signed June 6, 2003, was implemented in both countries on January 1, 2004. Under the agreement, all U.S. duties on fruit and vegetable imports from Chile were scheduled to be eliminated by the year 2015. Most fruit and vegetable items were granted duty-free status immediately when the agreement came into force. However, some products were subject to tariff elimination phased over several years. U.S. imports of certain frozen vegetables and grape juice from Chile (subject products of these investigations) continue to be subject to duties in 2008, with duties scheduled for elimination by 2011. In addition, the U.S.-Chile FTA established anannual tariff-rate quota of 950 metric tons for U.S. imports of canned artichokes from Chile (also covered in these investigations), continuing at the same volume through 2014, with in-quota product entering duty free. Over-quota imports of canned artichokes faced a base tariff of 14.9 percent ad valorem with phased elimination, varying with the value of the good sentered, through 2014.
