The Truth in Lending Act requires disclosure of the finance charge, the cost of211u001econsumer credit expressed as a dollar amount. The uniform disclosure of financing 211u001ecosts is designed to assist consumers in shopping for credit products. The cost 211u001eof credit under the act is also expressed as an annual percentage rate. The 211u001efinance charge does not include every cost associated with obtaining consumer 211u001ecredit, such as many charges paid in a real estate-secured loan. From the 211u001ebeginning of the discussion about the concept of 'Truth in Lending' in the 1960's 211u001ethere has been a considerable debate about which costs should be classified as 211u001efinance charges for disclosure purposes. Over the years, a complex set of rules 211u001ehas attempted to define with precision which charges should or should not be 211u001econsidered finance charges. Despite these rules, ambiguities have persisted, and 211u001ein recent years lenders have become increasingly concerned about litigation 211u001ealleging incorrect categorization of these charges. The report discusses the 211u001efeasibility of treating as finance charges all costs required by the creditor or 211u001epaid by the consumer as an incident of the credit. The Board is also asked to 211u001eaddress any abusive refinancing practices that creditors may use to avoid the 211u001ethree-day right of rescission provided by the law for certain transactions 211u001esecured by the borrowers home. This report presents the Boards preliminary 211u001eanalysis of these issues.
