TRANSITION FROM RCRA TO CAA TITLE V PERMIT CONDITIONS FOR HAZARDOUS WASTE COMBUSTORS

With the 40 CFR 63 Subpart EEE compliance date of September 30, 2003 now past, facilities subject to this rule will likely be turning their attention to the process of removing previous limits for their combustors from their Resource Conservation and Recovery Act (RCRA) permits and incorporating new limits into their Clean Air Act (CAA) title V permits. However, an understanding of how this transition can best be accomplished requires a consideration of multiple RCRA and CAA rulemakings that have occurred over the past several years, and roles that the state and EPA regions will play in implementing these provisions. Numerous Subpart EEE provisions and RCRA amendments were promulgated as part of the initial September, 30, 1999 HWC MACT rulemaking to facilitate this transition period. Also, details for incorporating the Subpart EEE requirements into a facility's title V permit are described in the 40 CFR 70 and 40 CFR 71 provisions. In addition, HWC MACT amendments promulgated as part of the February 13, 2002 Interim Standards Rule added new CAA and RCRA provisions which impact whether permit limits that apply during periods of startup, shutdown, and malfunctions will have to remain in RCRA permits. Developing and implementing an effective permitting strategy from this scattering of provisions throughout numerous chapters and parts of the environmental regulation, confounded by the lack precedent and agency experience with this regulatory process, may prove to be a formidable effort. The purpose of this paper is to summarize these numerous requirements with emphasis on provisions that impact key negotiations, decisions and timing for accomplishing the transition of permit conditions from the RCRA to the title V permit.
