Compliance Under Title V: Are You Certifiable?

When Congress amended the Federal Clean Air Act in 1990, they created, under Title V of the Amendments, provisions for a national operating permit program and required EPA to promulgate regulations specifying the minimum elements for state operating permit programs for major sources. The intent of Title V is to provide a mechanism to list in one document all a sites applicable air pollution control requirements. However, they also provided requirements for annual certifications and reporting of any compliance deviations. This has changed the intent of Title V by making it a compliance and enforcement tool rather than a road map for entities to follow to assure compliance. Given the hundreds and possibly thousands of potential requirements an entity is subject to has made certifying compliance an emotional issue. This paper will review how this happened and offer guidance to environmental managers on what to do to assure compliance and reduce the stress of annual certification reporting.
