In 1997, this author described to the NPRA Environmental Committee a refinery client's experiences with execution of a search warrant. For some in the audience, it was a first introduction to environmental criminal law. As Paul Harvey would say, this is the rest of the story of this 15-year saga, stretching from 1996 to 2011.On September 5, 1996, federal agents executed a search warrant on Canal Refining Company (Canal), a small refiner in western Louisiana. Agents of the Federal Bureau of Investigation, the Environmental Protection Agency, the United States Marshals Service, the United States Coast Guard, and the Louisiana State Police participated in the search. The various agents gathered documents, which was within the scope of the warrant, and interviewed various refinery personnel, which was not within the scope of the search warrant. Reportedly, the various agents in a heavy-handed manner prevented refinery office personnel from leaving, using the restrooms, or calling home or daycare centers to make child care arrangements.
