The practical reality and the specific literature emphasize the fact that social phenomena found in the content of the concepts of deviance, delinquency, crime, preoccupy more and more intensely not only the specialists in this field of concern (the specialists in the field of psychology) but also the political, governmental factors, the public opinion on an intern, regional point of view but also in an international one. Juvenile delinquency determines a series of negative sanctions, that involve the police, the justice courts, some reclusion institutions as the juvenile delinquency is characterised by a series of features and distinct notes from one society to another. Juvenile delinquency derives from the social- economic conditions of life, the cultural conditions from one society, being influenced also by the means to conceive, , treat and sanction the offences committed by minors and young people. We appreciate that, the subject on this matter is an important one especially from the criminal law's point of view, mainly because in Romania, minors are criminally liable from the age of 14 if it is proven that they acted with discernment, while from the age of 16 minors are presumed to have acted with discernment, and they are criminally liable.
