作为主体性的人的产物，法治也会出现异化，致使法治脱离人民主体地位，成为治民而不是治权的工具，从而带来人民对其“法律”的排斥和疏离。当前中国的法治建设在技术层面虽有很大进步，但由于法治运行中人民主体性严重不足，法律无法控制权力，法律权威难以树立，法治异化苗头初现。预防法治异化的关键在于发展民主政治，而在中国则是要按照“全面推进依法治国”的要求，落实好人民代表大会制度，实现党的领导、人民当家作主、依法治国的真正统一。%As the product of the subjectivity of the people,the execution of law might be alienated, resulting in the situation that the law does not serve the people,and it becomes the tool that governs the people rather than that regulate the power,which will alienate the people.The construction of law in China has made a great progress at the technical level,but because there is a lack of people’s subjectivity during the operation of law,law can not be used to control the abuse of power,and legal authority is dif-ficult to realize.So the people faces the alienation of law.Preventing the alienation of law lies in the de-velopment of democratic politics.In accordance with the requirements of Ruling the Country By Law,it is necessary to carry out the implementation of the unity of the people’s Congress system,the realiza-tion of the party’s leadership,the people being the master of the country and ruling the country by law.
