未成年人刑事案件社会调查是少年司法不同于成人司法的一项特殊且重要的制度。通过社会调查可以全方位了解并掌握未成年犯罪嫌疑人与被告人的犯罪原因、日常表现以及评估其人身危险性等，这有利于少年司法工作的开展，有利于对涉罪未成人的保护，有利于法治国家的建设。针对司法实践中未成年人刑事案件社会调查制度存在的一些问题，并结合域外经验，宜从确定社会调查启动程序与时间点、明确社会调查报告之性质、提高社会调查员之素质等方面入手，科学合理的构建未成年人刑事案件之社会调查制度。%The social survey of juvenile criminal cases is a special and important system of juvenile justice , which is different from adult justice.Fully knowing and grasping juvenile suspects and defendants ’ causes of crime, daily performance and assessment of personal danger through the social survey , can make for the conduction of juvenile justice work , make for the protection of ju-venile involving in crimes , and make for the construction of legal state .For some problems existing in the social survey system of juvenile criminal cases in judicial practice , combined with extraterritorial experience , it is appropriate to construct a scientific and reasonable social survey system of juvenile criminal cases by starting from determining the start time and program of social survey, clearing the nature of social survey report and improving the quality of social surveyors .
