摘要

QCan a facility still be sued for nuisance if it has a valid planning permission in place? What about if it also has an environmental permit? A Certain waste and other industrial activities inevitably give rise to some unavoidable impacts, such as noise, vibrations and odour. These impacts are assessed in the course of the planning process, and often conditions are imposed to address them. Many such facilities will require environmental permits, bringing such impacts under even greater scrutiny and imposing tighter conditions to control the operations at the site. The intention is to ensure, as far as possible, that such activities are not situated in locations where they could impact on sensitive receptors, such as people's living and working environments, and that where appropriate control and regulatory oversight is applied to such facilities through the permitting regime.
